Terms of Service

1. Introduction

Welcome to WriteBand. These Terms of Service ("Terms") govern your access to and use of the WriteBand website, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

WriteBand provides an AI-powered platform for IELTS writing preparation, practice, and feedback. These Terms constitute a legally binding agreement between you and WriteBand regarding your use of the Service.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet the eligibility requirements. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

3. Accounts and Registration

To access certain features of the Service, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify WriteBand immediately of any unauthorized use of your account.

WriteBand reserves the right to disable your account if, in our judgment, you have violated these Terms.

4. User Content

The Service allows you to create, upload, and share content, including essays, responses, and other materials ("User Content"). You retain all rights in your User Content, but you grant WriteBand a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to your User Content and that your User Content does not violate the rights of any third party, including intellectual property rights and privacy rights.

5. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate or infringe other people's intellectual property, privacy, or other rights
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any part of the Service or any accounts, systems, or networks
• Use any automated means or interface not provided by us to access the Service or extract data
• Use the Service to send altered, deceptive, or false source-identifying information
• Share your account credentials or access to your account with any third party
• Submit content that is defamatory, abusive, harassing, threatening, or invasive of another's privacy

6. Subscription and Payment

Some features of the Service may require a subscription. By subscribing to a paid plan, you agree to pay the subscription fees as described at the time of purchase. Subscription fees are non-refundable except as required by law or as explicitly stated in our Refund Policy.

WriteBand reserves the right to change subscription fees upon reasonable notice. Such notice may be provided by email, through the Service, or by posting the changes on the WriteBand website.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by WriteBand and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, create derivative works, publicly display, publicly perform, republish, or transmit any material from the Service without prior written consent from WriteBand.

WriteBand respects the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WRITEBAND DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WRITEBAND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Indemnification

You agree to defend, indemnify, and hold harmless WriteBand and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

11. Termination

WriteBand may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

WriteBand reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in London, United Kingdom.
