1. Agreement to Terms
By accessing or using WriteBand ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the service.
2. Description of Service
WriteBand provides an online IELTS Academic exam preparation platform that includes:
- Practice tasks for Reading, Writing, Listening, and Speaking modules
- AI-powered grading and feedback for Writing tasks
- Progress tracking and performance analytics
- Educational course content and study guides
3. Account Registration
To use certain features of WriteBand, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or illegal activities.
4. Subscription Plans and Pricing
4.1 Free Tier
WriteBand offers a free tier that includes:
- 1 Reading practice task
- 1 Listening practice task
- Unlimited Speaking flashcards
- Access to all course content
4.2 Premium Subscription
Our Premium subscription ($39/month) provides:
- Unlimited Reading practice tasks
- Unlimited Listening practice tasks
- Unlimited Writing practice tasks with AI grading
- All Speaking flashcards
- Progress tracking and analytics
- All course content and study guides
4.3 Billing
Premium subscriptions are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscription fees are non-refundable except as required by law or as stated in our Refund Policy.
5. Cancellation and Refund Policy
5.1 Cancellation
You may cancel your Premium subscription at any time from your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to Premium features until that date.
5.2 Refund Policy
We offer a 7-day money-back guarantee for new Premium subscriptions. If you are not satisfied within the first 7 days, contact us at support@writeband.com for a full refund. After 7 days, subscription fees are non-refundable.
6. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or in violation of these Terms
- Share your account credentials with others
- Attempt to gain unauthorized access to any part of the service
- Copy, reproduce, or redistribute any content from the platform without permission
- Use automated tools (bots, scrapers) to access the service
- Interfere with or disrupt the service or servers
- Upload malicious code or attempt to compromise system security
- Impersonate another person or entity
7. Intellectual Property
All content on WriteBand, including but not limited to text, graphics, logos, practice tasks, course materials, and software, is the property of WriteBand or its content suppliers and is protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the service for personal, non-commercial purposes only.
8. User-Generated Content
By submitting content (such as writing task responses), you grant WriteBand a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing the service, including AI grading and feedback.
We will not share your practice task submissions publicly or with third parties without your consent.
9. AI Grading Disclaimer
Our AI grading system is designed to provide helpful feedback based on IELTS band descriptors. However, AI grading is not a substitute for official IELTS scoring by trained examiners. Band scores provided by WriteBand are estimates for practice purposes only and do not guarantee similar results in actual IELTS exams.
10. Disclaimer of Warranties
WriteBand is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- The service will be uninterrupted, secure, or error-free
- The results from using the service will be accurate or reliable
- Use of the service will guarantee improvement in IELTS scores
- Any errors will be corrected
11. Limitation of Liability
To the fullest extent permitted by law, WriteBand shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
12. Indemnification
You agree to indemnify and hold WriteBand harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service or violation of these Terms.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the service. Continued use of the service after changes constitutes acceptance of the new Terms.
14. Termination
We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service will immediately cease.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WriteBand operates, without regard to conflict of law principles.
